Will I lose my car if I file bankruptcy?

Let’s cut to the chase: Not with me as your attorney, you won’t.

In over 17 years of helping people file bankruptcy, I’ve never had a client lose something they didn’t want to lose — and I’m not starting now. Unless you’re rolling around in a rare, movie-authentic 1985 DeLorean or a cherry red Ferrari, the bankruptcy court isn’t interested in taking your ride.

👀 So… How Do I Keep My Car?

In most cases, it’s simple:
Just keep making your payments.

If you’re still paying on the loan:

  • Keep it current and you’re good.
  • Bankruptcy doesn’t wipe out your car unless you stop paying or you want out of a bad deal.

If the car is paid off:

  • Great! As long as you don’t have in excess of $20,000 of equity you will likely be fine. Or if you are nervous – file chapter 13!

Let’s be real — unless you’ve got a rare collector car, the court’s not coming for your ride. Nobody’s chasing down your 2009 Honda CR-V with 189k miles and a dent in the door. Promise.
